Why is consistency important?


In analysing a number of cases where there had been a dispute about the adjustment(s) offered or refused in relation to health and physical capacity to train to teach, it was clear that the most frequent reason for the complainants being successful was that they had been treated unfairly through inconsistent application of the requirements.  Therefore, the biggest risk to the sector is that it may be established that a different ITT provider may have arrived at a different decision.  The general nature of the statutory regulations lays the sector very open to variation in interpretation.
